Consider Debt Relief Solutions Before Filing Bankruptcy

If the thought of filing for bankruptcy has actually crossed your mind, you may want to give due consideration to some of the debt relief solutions available before you make such a serious financial move. There are many debt relief solutions that you can choose and many solutions on offer are far better than filing for bankruptcy. You will find that through a number of different debt relief companies, you can get your debt back under your control and you can avoid the stigma and difficulties that accompany bankruptcy filings.
First, let's consider what happens when someone files for bankruptcy. If the consumer chooses to file for chapter 7 bankruptcy, all eligible debts that are included in the filing are eliminated; the key word here is "eligible" debts, because some debts cannot be included into a bankruptcy filing. Debts that will remain include things like student loans. During a chapter 7 filing, the consumer's main assets are often at risk and the individual can lose their house, their car, and other costly items so that some of the monies from sold assets can be used to pay off debtors. Meanwhile, a chapter 13 filing allows the consumer to keep his or her assets, but it does not protect the consumer's credit score. Any kind of bankruptcy filing results in seven to ten years of damage on one's score.
Debt Relief Solutions include a number of different options. You might consider entering into debt relief counseling where you are offered guidance about how to create a budget, how to pay off debts, and how to prevent debt accumulation in the future. You can also consider debt relief solutions involving debt consolidation measures; this will involve getting a loan of some kind so that all of your existing debts can be paid with immediacy. What remains in the latter situation is the new loan, often associated with better interest rates and lower monthly payments. Meanwhile, there are companies that offer consumers debt settlement services: such services involve negotiating debts with creditors so that the debtor pays an agreed to amount. The latter services help to diminish overall debt, to establish a payment plan, and the debtor eventually gets out of debt over an extended period of time.
Debt relief solutions, when compared to bankruptcy filings are clearly the better option when seeking to get out of debt. When seeking out debt relief options one will find that it may take some time to get out of debt, but the long-term damage to one's credit is minimal. In addition, there is no threat to one's assets when seeking out quality debt resolution services.

Bankruptcy is not considered well for the economy because it hinders the smooth flow of money as the lenders don't get their money back. With so many people filing for bankruptcy, the economy started facing major set backs. The government, as a result, came out with a stimulus package through which debt relief alternatives were introduced. These relief options benefit both the consumer and the creditor and do not have any adverse effect on the economy.

When you fill for bankruptcy your credit rating is so much damaged that it is impossible to get any loan in future. You can lose your valuable assets; also, you have to face a lot of insult in the society. Debt relief alternatives allow you to overcome your debts respectfully no matter how big they are. Most importantly your creditor rating is not damaged much. The most popular of relief programs are debt settlement and debt consolidations. Debt settlement is the right choice if your unsecured debts are massive. In debt settlement you can overcome your debt by acquiring debt reduction. Negotiations are made with the creditors to convince them for the reduction in debt. Usually you can have your debt reduced to 50 or 60% of the total outstanding balance. The remaining debt becomes bearable for you. You can pay the remaining loan in easily manageable monthly installments in a separate settlement account. The debt settlement experts can help you in this regard. The point is that it enables you to get rid of the loan without any burden on your finance.

Don't have massive debts; you can go for a cheap consolidation loan. This helps you get rid of the debt instantly. The consolidation loan can then be paid back on a very low interest rate in a much longer time period. Bankruptcy should be kept as your last debt relief option, as there are better alternatives which should be considered first.

If I File for Bankruptcy Will My Student Loans Get Discharged?

So are student loans able to be discharged? In short, probably not. Student loan debts are nondischargeable in Chapter 7 Bankruptcy cases unless paying the debt would cause the debtor "undue hardship." This basic rule also applies to Chapter 13 Bankruptcy cases.

Discharge of student loans received popularity in the 1970's. Many individuals would file for bankruptcy shortly after completing their expensive education. The goal was to discharge these student loans before they began earning money.

The wording of the exception of a "hardship discharge" and what is considered a student loan has recently been broadened so that most student loans made by nonprofit groups or the government are now considered student loans. This only applies to the actual student and not a co-signor. So a parent signing for one of their children could not have this debt discharged. In addition, this exception does not include debts to an educational institution for tuition. If the loan is nondischargeable then the petition on the loan is also not going to be discharged.

So we turn to "undue hardship." Most published court opinions agree that "undue hardship" means more than garden variety hardships that come with the costs of future payments. Several circuit courts of appeals have developed a three-prong test.

In summation, the debtor cannot maintain a minimal standard of living and his dependents are left with the debt, some additional circumstances in regard to the standard of living would extend over the life of the repayment of the loan, and the debtor has tried to the best of their ability to pay off the loan according to the plan.

The ideal debtor who will successfully discharge student loans are the low-income debtors. The debtor has the burden of proving their hardships. Any reason that makes this loan impossible for the debtor should be made known to your attorney. For example, unemployable debtors, underprivileged debtors, a total lack of available jobs suited for the debtor's skills, certain disabilities, etc. If any of these situations exist, your attorney will strive to prove any extenuating circumstances to the court to get these student loans discharged.

Evaluate Before Taking Student Loan Consolidation Loans

Debt is an easy thing to get into. It seems that everywhere, everyone wants to give us a loan, credit card, store cards, etc. It all can put us in a bad position, especially for students. Students are finding it hard to pay back student loans, so can student loan consolidation loans make life easier for students?

Today, it only happens to the few that they can simply get a good education without having to worry about loans after. For most of us, we need to take out a student loan to be able to get a good education.

Education is important, and you know this. We all either have 2 options after formal schooling, that is either get a job and earn today or go through education in the hopes of doing a job which we want to do and or that pays us more money, than if we simply went to work straight after school.

Students are still finding it hard however. Many student loans we get barely cover all our necessary expenses to go through the course. This is where student loan consolidation comes to aid; however, it is a point to consider before getting student loan consolidation loans.

What student loan consolidation is is a way to get all those student loans and put them into one place. Generally the higher the borrowing rate, the better level of interest you can get on the loan. This is what makes student consolidation loans attractive.

You simply get all those student loans and put them into student loan consolidation and you have a better rate, and also better ability to manage the payments. However, even though it seems so rosy, the truth is that you need to evaluate before taking out student loan consolidation.

The first thing to consider is the terms. If you were thinking of using that money to pay back that big credit card balance, think again! Most of the student loan consolidation companies do not allow using the money on paying back credit cards, or any other normal loans.

Another point to consider is that of the amount you have to pay back. Most student loans provide a way, where you pay less now, and on increasing amounts after your education. This makes life much easier, as the normal rate of what you have to pay back is out of reach for almost all students.

This makes considering about your future an important thing to do. The road you are headed up, will the jobs there provide the necessary income for you to be able to pay back the student loan consolidation loan without having to resort to even more debt?

Student loans and student loan consolidation loans can seem daunting, but for many it is the only way to get a good education. With a bit of thought about your future and your position today, you can create a winning situation which does not have to resort in getting any less of a student's lifestyle.

Things You Need to Know Before You Consolidate Debt Loans

The best and easiest way to consolidate debt loans programs is the federal government debt consolidation loan programs. While these federal government programs are the best for student loans, there are some other options from the private sector which are relatively good as well.

Private loan consolidation lenders, agencies and companies

There are many private consolidation lenders and companies that offer these programs to all students seeking some financial help. Student seeking to obtain or looking for such federal government loans should be aware of some tricks and ploys these companies try to do. They do all kinds of tricks in order to get you to consolidate debts with them.

Here are some tips you have to consider and watch out for when you consolidate debt loans:

The most frequent line of talk used and employed by these private agencies and companies. They will inform or tell you about the free debt consolidation loan program of the Federal Governments-US Department of Education. When a student or borrower hears the word Federal Government, They assume that they are talking to the department of education representative or employee. The trick here is for you to have a sense of actually feeling that you are talking to the federal government which is not.

Always bear in mind when talking over the phone to ask what company he/she is working for. What these private agencies and companies try to portray is a feeling a trust. Once you trust who you are talking to you go deeper into the details of what you are looking for and sometimes get trapped. And by trusting them you are trapped and would be willing to give out some personal information which they always look to obtain from their prospective clients. So beware of these tricks.

There are other tricks which they try to use or employ to lure you as one of their upcoming borrower. They will convey to you a sense of urgency and that you have to do it right now or lose out on it.They will claim that now is the best time to consolidate debt loans because interest rates are low.

They will use the low interest rate now and that sense of urgency to try to get or lure you into doing your consolidation now before the interest rate will go up.

They will offer X amount of percentage discount on the interest rate if your payments are made by automatic payment direct debit from your bank account. This to me is a red flag. Do not give access to your bank accounts.

They will try and ask for your student account number which in most cases it is your social security number. If you give this information to them, they can find your record on the national student loan data system (NSLDS). Here, they can see if you are eligible or not. This is a way for them to make you give your social security number.

They will always try and make you feel that what they are offering is a federal program. Simply put, they will reiterate that it is a federal program through the federal government.

Always consider these tips before deciding to consolidate debt loans.

Student Loan Consolidation Info - Things To Take Into Consideration Before Getting A Student Loan

Before getting a student loan, it is important to understand that you should only borrow for the cost of attendance including your tuition, lab fees, books, and any living expenses you will have throughout the year. Of course this amount should be lowered by any other financial assistance you will receive. If you have been awarded a grant or scholarship, you should be able to lower your loan amount by the amount that has been awarded to you.

Often, the school you want to attend figures the cost of attendance for a wide range of students and they don't take into consideration any grants or scholarships when publishing this dollar amount. You may not need to borrow as much as the school says you will due to your circumstances. Borrowing less money now lowers your financial obligations in the future when it's time to start paying back the loan.

If you find you need more money than your school allows to cover the cost of attendance, you can make an appeal to have it re-evaluated. However, the amount you are asking for cannot go over the amount that federal regulations has established as a maximum amount to be borrowed.

If you are completely financing your education with student loans, be sure to check into how much the borrowing restrictions are for your lender. The federal government places restrictions on borrowing amounts yearly and for the total amount you can borrow during your education. Make sure you evaluate the terms for each loan you will take on for the yearly and total restrictions.

Take a close look at the financial commitments you currently have and honestly assess your current financial status. Doing this before you enter school can let you have a better understanding of where you are at in your current finances. After school, you will be responsible for any of the student loans you have taken and any prior debt that you had as well.

Now take a moment to consider what your realistic future income will be. Do some job market research online for the areas you plan on living after you attain your degree. Your future income pays a big part in how much student loan debt you will be able to pay back after you leave school. Taking this into consideration before getting a student loan will help you to determine alternative payment plans to assist you with making your payments early in your career.
